HOW TO FILE A COMPLAINT OR LAWSUIT
If you believe
your discharge was unlawful because of:
•Discrimination
because of race, sex, national origin, religion, pregnancy (Title
VII),
age (ADEA), disability (ADA), or retaliation, you have 300/180
days after
notification of the adverse employment action for Private Sector
and State
Employees to file a charge with the Equal Employment Opportunity
Commission
(EEOC). **Note: If your state has an agency that accepts and investigates
discrimination claims, you have 300 days to file a charge with
the EEOC; if there is
no such agency in your state, you have only 180 days to file a
charge with the
EEOC.
•Discrimination
or a discharge without just cause, you must file a charge with
the
US Merit System Protection Board (MSPB) up to 30 days after notification
of
the unjust decision for federal service employees.
•Complaints
you made about unsafe working conditions or your refusal to perform
work you believe to be unsafe, you must file a charge within 30
days with the
Occupational Safety and Health Administration (OSHA).
•The
Family and Medical Leave Act, you have up to two years to file
a charge with
the US Department of Labor, Wage & Hour Division, and federal
court.
•Fair
Labor Standards Act, you have up to two years to file a charge
with US
Department of Labor, Wage & Hour Division, and federal court.
